Acceptance of Terms
By browsing this website, placing an order, or purchasing and using any Track & Wake Accessories product (the "Product"), you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not purchase or use our Products.
Product Disclaimer
All Products are sold as accessories only and are used entirely at the purchaser's own risk. Products are not safety devices, load-rated equipment, or structural components, and must not be relied upon as such. We make no representation that a Product is suitable for any particular vehicle, vessel, machine or purpose beyond the general descriptions provided on this website.
Product Use
Products are intended for reasonable, everyday use in the applications described on the relevant product page. They must not be modified, overloaded, used to carry items beyond their intended size or weight, or used in a manner inconsistent with their intended purpose. Any such use voids all warranties and is undertaken solely at the user's risk.
Installation Responsibility
It is the responsibility of the purchaser or user to ensure each Product is fitted securely and correctly, using appropriate hardware and mounting points, and that the installation does not interfere with the safe operation of any vehicle, vessel or machine. Fittings should be inspected regularly for wear, loosening, fatigue or damage, and any affected Product should be removed from service immediately. Track & Wake Accessories accepts no responsibility for improper installation, unsuitable mounting locations, modification, or failure to carry out regular inspection.
Safe & Lawful Use
You must comply with all applicable Australian federal, state and territory laws and regulations, and with any equivalent laws in your jurisdiction, when installing and using our Products. This includes road, workplace, marine and heavy-vehicle safety requirements. Products must never be used in a way that distracts an operator, obstructs controls or vision, or otherwise compromises safe operation.
No Alcohol Use
Our Products must not be used to hold, carry, transport or facilitate the consumption of alcoholic beverages while operating any vehicle, vessel, quad bike, machinery or plant. Track & Wake Accessories does not condone drinking while driving, riding or operating equipment in any circumstances. Any use of a Product that encourages or facilitates alcohol consumption during operation is a breach of these terms and is entirely the responsibility of the user.
Product Compatibility
Compatibility information, vehicle models and drinkware references are provided as a guide only, based on the items we have tested. Vehicles, accessories and drinkware vary between models, years, markets and revisions. It is the purchaser's responsibility to confirm fitment and measurements before purchase. We are not liable for a Product that does not fit an untested or non-standard application.
3D Printed Products
Our Products are manufactured using 3D printing in small batches. Minor cosmetic variations such as visible layer lines, slight colour or finish differences between batches, small surface marks and minor dimensional tolerances are a normal characteristic of the process and are not considered defects. Printed materials can also be affected by prolonged exposure to extreme heat, sustained direct sunlight, chemicals or solvents.
Limitation of Liability
To the maximum extent permitted by law, Track & Wake Accessories, its owners, employees and suppliers are not liable for any injury, death, vehicle or vessel damage, property damage, loss of use, financial loss, consequential loss or legal consequence arising from the purchase, installation, use, misuse or failure of any Product, whether or not such loss was foreseeable. Where liability cannot be excluded, our liability is limited, at our option, to the replacement of the Product or the refund of the purchase price.
Warranty
We warrant that Products are free from manufacturing defects at the time of dispatch. If you believe a Product is defective, contact us with your order details and photographs within a reasonable period of receipt and we will assess the claim. This warranty does not cover normal wear and tear, cosmetic variation inherent to 3D printing, damage from incorrect installation, impact, overloading, modification, accident, or exposure to extreme conditions.
Returns & Refunds
Faulty or incorrectly supplied items will be repaired, replaced or refunded in line with our Returns Policy and your rights under Australian Consumer Law. Custom, made-to-order and personalised items, including Products supplied with a customer-supplied logo, are generally not returnable for change of mind. Intellectual Property
All designs, product models, text, photography, graphics, logos and other content on this website are the property of Track & Wake Accessories unless otherwise indicated. Our Products and designs must not be copied, reverse engineered, scanned, reproduced or resold without our prior written permission. Any logo or artwork you supply for a custom Product remains yours, and by supplying it you confirm you have the right to use it and authorise us to reproduce it for the purpose of fulfilling your order.
Indemnity
You agree to indemnify and hold harmless Track & Wake Accessories from and against any claims, demands, actions, damages, penalties, costs or liabilities (including legal costs) arising from your installation or use of a Product, your breach of these terms, or any third-party claim connected with your use of a Product.
Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our Products come with consumer guarantees that cannot be excluded, and these terms apply only to the extent permitted by law.
Governing Law & Changes to These Terms
These terms are governed by the laws of Tasmania, Australia. We may update these Terms & Conditions from time to time, and the version published on this page at the time of your order applies to that order. If you have any questions, please get in touch through our Contact page.
